Revised Collection Policy; Late Fee Increased to $45
At the July 8 meeting, the Board voted unanimously to adopt an updated collection policy addressing the process and procedures to be followed for notification and collection of delinquent assessments. The major change to the policy is that the late payment fee amount has been set at $45. While the $45 appears to be a significant increase over the previous fee of $15, the prior policy was not as clear as it needed to be in addressing the other charges associated with pursuing the collection of delinquent assessments that were added to the total amount due. The new policy ties all of these costs together with the intent of providing a clear understanding to the homeowner of what the costs are for having delinquent accounts.
The other significant changes to the policy are contained in the notification procedures that will be taken when an account is found to be delinquent, including the process of referring an account to the MPOA collections attorney.
Homeowners are reminded that the due date for assessment payments remains the 1st of the month. Payments made after the 10th will be charged a late fee. Homeowners are strongly advised that depositing a payment in the drop slot outside of the Montclair office building on the 10th of the month does not ensure that the payment will be credited in time to avoid a late fee.
